EPA moves to roll back the PFAS water mandate: proposed rescission of four of six limits (May 2026)
On 20 May 2026 EPA published a proposed rule (Federal Register doc 2026-10085; 91 FR 29413; RIN 2040-AG53; docket EPA-HQ-OW-2025-0654) to rescind the 2024 regulatory determinations and drinking-water limits for four PFAS - PFHxS, PFNA, HFPO-DA (GenX) and their Hazard-Index mixture with PFBS - amending 40 CFR 141 and 142. A companion rule keeps the PFOA/PFOS limits but extends compliance to 2031. Comments close 20 July 2026; the first federal attempt to weaken the non-toxic-water mandate.
This is the net-new rollback event, distinct from the standing
pfas-enforceable-drinking-water-limits card (which documents the 2024
establishment of the limits and flags this rescission only as a one-line
risk). EPA now has a fully docketed proposed rule to withdraw the 2024
regulatory determinations for four of the six regulated PFAS — PFHxS, PFNA,
HFPO-DA (GenX), and the Hazard-Index mixture of those three plus PFBS — and to
remove the related provisions from 40 CFR Parts 141-142. A separate,
simultaneously announced rule retains the enforceable 4.0 ppt MCLs for PFOA and
PFOS but offers systems two extra years (to 2031) to comply.
Why it matters (money + metacrisis). The 2024 MCLs were the demand engine behind PFAS-free materials and utility-scale treatment (GAC / ion exchange / RO). Rescinding four of six determinations and delaying PFOA/PFOS compliance shifts utility capex timing and dilutes the value of blanket "PFAS-free" claims for GenX-class chemistries. The deeper lever: toxics governance is reversible. When the federal floor wobbles, independently verified contaminant and material data become more valuable, not less — which is squarely the ground the gardens are meant to hold.
What would prove it wrong. EPA withdraws the proposal, or a court vacates it, or the agency simply never finalizes it and the 2024 determinations stand — any of which would refute the "the mandate is being rolled back" reading. The converse confirmer is a final rule enacting the rescission; as of now it is a proposal only.
Live-status check (2026-07-07). Federal Register document 2026-10085 is published (citation 91 FR 29413, RIN 2040-AG53, docket EPA-HQ-OW-2025-0654), with a govinfo PDF (FR-2026-05-20/pdf/2026-10085.pdf) and 26 comments posted on regulations.gov. Status: proposed, comment period open through 20 July 2026; not yet final and not superseded. The 2024 PFOA/PFOS MCLs (4.0 ppt) remain operative. A genuine primary that is genuine and not-yet-binding — the exact "real but not final" case the discipline rules warn about.
Re-price the non-toxic thesis's regulatory tailwind as partially reversing rather than settled; track docket EPA-HQ-OW-2025-0654 to final action, and treat PFHxS/PFNA/GenX removal capacity as policy-contingent (not mandated) while PFOA/PFOS stays enforceable.
